Terms of Service

Provided by PITIR TECH

DijiStream is operated by PITIR TECH (Ninu Limited, UK). These terms are governed by the laws of England and Wales.

01

Agreement to These Terms

These Terms of Service (the "Terms") form a legally binding agreement between you and PITIR TECH, the trading name of Ninu Limited, a company registered in England and Wales ("PITIR TECH", "we", "us", or "our"), covering your use of the DijiStream platform (the "Service") and your purchase of any subscription plan for it.

DijiStream is a multi-tenant, cloud-hosted CRM. You connect your own third-party accounts, DijiStream gathers the messages, leads, comments and reviews they receive into one panel, and you reply through your own accounts. By creating a Workspace, connecting an account, or purchasing a plan, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Refund Policy, which are incorporated into these Terms by reference. If you enter into these Terms on behalf of a company or other organisation, you confirm that you have authority to bind it, and "you" means that organisation.

In these Terms, the following capitalised words have these meanings:

  • "Service" or "DijiStream" — the DijiStream CRM platform, its panel, websites, APIs, and related features.
  • "Customer", "you" or "your" — the individual or organisation that creates a Workspace or subscribes to a plan.
  • "Workspace" — the isolated tenant within the Service in which your data is held and your team works.
  • "Connected Account" — a third-party account or platform (such as Facebook, Instagram, YouTube, Google, Gmail, WhatsApp, Shopify or WordPress) that you link to the Service.
  • "Workspace Content" — the messages, leads, contacts, comments, reviews, and other data ingested from your Connected Accounts, together with everything you and your team create, upload, or store in your Workspace, including the personal data of your own customers.
  • "Sub-processor" — a third party we engage to help us provide the Service.

If you do not agree with these Terms, do not create a workspace, do not connect any account, and do not purchase a subscription.

For how we handle data — including your encrypted platform credentials and the content ingested from your connected accounts — see our Privacy Policy. In short: for your workspace content you are the controller and DijiStream acts as your processor; for account and billing data we are the controller.

02

The Service

DijiStream is provided as a subscription service, accessed through your browser. Its core function is to act as a single panel for the conversations your business already has elsewhere:

  • You connect the third-party accounts you already own — such as Facebook, Instagram, YouTube, Google, Gmail, WhatsApp, Shopify and WordPress — by pasting one API key or credential per platform.
  • DijiStream ingests the incoming messages, leads, comments and reviews from those accounts into your Workspace.
  • You read, organise, and reply — and every reply is sent through your own account on the relevant platform.

The Service is licensed, not sold. Subject to these Terms and your payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own internal business purposes for as long as your subscription is active. This licence is personal to your Workspace and does not permit you to make the Service, or its features, available to any third party as your own offering. We reserve all rights not expressly granted to you in these Terms.

DijiStream never messages anyone on its own initiative. Email replies are sent through Amazon SES on your behalf, from your own address, authorised by DNS records you install — and the platform is strictly reply-only: it cannot send cold or marketing email.

03

Your Account and Workspace

To use the Service you need an account and a Workspace. You agree to provide accurate registration information, to keep it up to date, and to keep your login credentials confidential. You are responsible for all activity that happens under your account and within your Workspace, including activity by the team members you invite within your plan's seat allowance.

The panel is accessible only to authenticated users. To help you protect your account we make two-factor authentication available — using either a TOTP authenticator app or a passkey — and we strongly recommend that you and every team member enable it. Where your plan includes team seats, you can use role-based access controls to limit what each member can see and do, and you are responsible for managing that access and revoking it promptly when someone leaves your team. Please tell us straight away at it@dijistream.com if you suspect any unauthorised access to or use of your account.

04

Connected Platforms and Credentials

You choose which platforms to connect. For each one you paste a single API key or credential, which is encrypted at the application layer with AES-256-GCM before it is stored, held on encrypted infrastructure, and never displayed back to you after saving. We use each credential only to fetch your incoming items from that Connected Account and to carry out the actions you take in your panel — DijiStream never acts on a Connected Account on its own initiative. You can replace a credential, or revoke a connection entirely, at any time from your panel; disconnecting a Connected Account also immediately and irreversibly removes the items imported from it, as described under "Your Content and Data".

Each Connected Account remains governed by the relevant provider's own terms and policies, in addition to these Terms. By connecting an account you confirm that:

  • You own the account, or have clear authority from its owner to connect it.
  • Your use of the connection complies with that platform's terms of service and developer policies.
  • You have any consents required to process the messages, leads, comments and reviews the connection delivers.

You authorise DijiStream, acting on your behalf and on your instructions, to use each connection you set up in order to provide the Service to you.

Third-party platforms control their own APIs. They may change, limit, or revoke access at any time, and connected features can be affected as a result. We work to keep integrations current, but we are not responsible for changes, outages, or restrictions imposed by the platforms themselves.

Fair use: DijiStream fetches your incoming items at reasonable intervals within each platform's rate limits. Attempting to force excessive polling, bulk scraping, or automation beyond the intended workflow is a breach of these Terms.

05

Plans, Pricing & Payment

DijiStream is sold as a monthly subscription on the pricing page, in five tiers priced in GBP: £9, £24, £49, £99, and £149 per month. Each tier's features and seat allowances are listed on the pricing page.

  • Checkout, subscription billing, and payment collection are handled entirely by Shopify, and payments are processed by Shopify Payments. Your card details are entered into, and held by, Shopify under its own PCI-compliant systems — full card numbers never reach, and are never stored by, DijiStream.
  • Prices are shown at checkout and may include applicable taxes (such as VAT) depending on your location.
  • We may change prices or the contents of a tier with reasonable notice. Any change applies from your next billing period — never retroactively to a period you have already paid for.

You agree to provide accurate billing details and authorise us, through Shopify, to charge the plan you select each billing period. We may correct any obvious pricing errors before fulfilling an order.

06

Renewal & Cancellation

All plans are monthly subscriptions that renew automatically at the then-current price until cancelled. You can cancel at any time; cancellation takes effect at the end of the billing period you have already paid for, and no further charges are made after that.

To cancel, use the subscription management link in your order confirmation email, or email it@dijistream.com from your account email address. Your Workspace stays fully active until the end of the period you have paid for. When that period ends your subscription closes and your Workspace Content enters a 30-day grace period, during which you can export it or resubscribe; after that window it is permanently and irreversibly deleted. We keep no separate backups, so once that window passes it cannot be recovered — please export anything you want to keep before your subscription ends (see "Your Content and Data").

If a renewal payment fails, we may retry it and may suspend access to the Service until payment succeeds. Your workspace data is not deleted because of a failed payment.

07

Refunds

Your first subscription payment is covered by a 14-day money-back guarantee, no questions asked. Renewal payments are not refundable, and there are no pro-rata refunds for partial billing periods — cancelling simply stops the next charge. See our Refund Policy for how to make a request. A refund ends your subscription; your Workspace Content then keeps the same 30-day grace period described under "Your Content and Data" before it is permanently and irreversibly deleted, and because we keep no backups it cannot be recovered after that — so export anything you want to keep before you request one.

08

Acceptable Use

You agree to use the Service lawfully, responsibly, and only as intended. In particular, you agree not to:

  • Use the Service to send spam or unsolicited messages of any kind. DijiStream is reply-only by design; attempting to work around that — including using it for cold outreach or marketing email — is a material breach of these Terms.
  • Upload, store, or transmit unlawful, infringing, defamatory, or malicious content, or any material that contains viruses or other harmful code, through the Service.
  • Process personal data through the Service without a lawful basis, or otherwise in breach of applicable data-protection or privacy law or the rights of the individuals concerned.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law.
  • Resell, sublicense, rent, lease, or otherwise provide the Service to third parties as your own offering.
  • Circumvent, or attempt to circumvent, tier limits, seat allowances, or fair-use API polling limits, or access the Service other than through the interfaces we provide.
  • Probe, scan, or test the vulnerability of the Service, or interfere with the security, integrity, or performance of the Service or of other customers' workspaces.

You are responsible for the replies you send and the content you handle through your connected accounts, including complying with the laws, consent requirements, and platform rules that apply to your business. We may suspend or terminate access for material breach of this section.

09

Your Content and Data

The messages, leads, contacts, comments and reviews ingested from your Connected Accounts — including the personal data of your own customers — together with everything you and your team create in your Workspace (your Workspace Content) belong to you. As between you and us, you retain all ownership of, and all rights in, your Workspace Content, and we claim no ownership of it.

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display your Workspace Content solely to provide, maintain, secure, and support the Service for you, and only on your instructions. That licence lasts only for as long as we hold your content in order to run the Service, and it ends when the content is deleted. We act as your data processor for this content, as set out under "Data Protection and Sub-processors" below. We never sell your Workspace Content, we never share it except with the sub-processors and Connected Accounts needed to run the Service, and we never use it for advertising or to train artificial-intelligence models.

Important — no backups. Your Workspace Content is held as a single live copy in your panel, and DijiStream keeps no separate backups of it. Because of that, deletion happens in two ways, and in both cases it is permanent — once content is deleted, neither you nor we can recover it:

  • Disconnecting a Connected Account, or deleting your account, from the panel purges the affected content immediately and irreversibly — it is removed as soon as you confirm the action.
  • When your subscription ends — by cancellation, termination, or refund — your Workspace Content remains for a 30-day grace period, during which you can still export it or resubscribe, and is then permanently and irreversibly deleted. Because there are no backups, it cannot be recovered after that window.

Since there is no backup to restore from, always export anything you want to keep before you disconnect an account, delete your account, or let your subscription end.

You can request an export of your Workspace Content, or ask us to delete it sooner, at any time by emailing it@dijistream.com from your account email address. Because we keep no backups and deletion is permanent once it takes effect, always export anything you need to retain before you disconnect an account, delete your account, cancel, or ask for a refund — see "Your Content and Data" for when each kind of deletion happens.

10

Intellectual Property

The Service — including the DijiStream platform, its software, source code, databases, design, look and feel, name, logo, and all underlying technology and documentation — is and remains owned by or licensed to PITIR TECH, and is protected by intellectual-property laws. In short: we own the platform, and you own your Workspace Content (see "Your Content and Data"). The DijiStream name and branding are our trade marks. Except for the limited licence to use the Service granted to you in these Terms, nothing here transfers to you any ownership of, or right in, the Service or our marks, and we reserve all rights not expressly granted.

If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the Service, with no obligation to you.

11

Updates, Availability & Support

We make commercially reasonable efforts to keep the Service available and performing well, but we do not guarantee uninterrupted or error-free operation. Planned maintenance and factors outside our control — including third-party platform APIs — can affect availability.

We may add, change, or improve features from time to time, and we will give you notice of material changes that affect how you use the Service. We will not remove a paid capability you rely on without a reasonable alternative or notice. While your subscription is active, updates are included at no extra cost, and you receive customer support by email at it@dijistream.com, answered within one business day (Mon–Fri, 9:00–18:00 UK time).

12

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT IT WILL OPERATE WITHOUT INTERRUPTION OR ERROR, OR THAT ANY THIRD-PARTY PLATFORM WILL REMAIN AVAILABLE OR COMPATIBLE.

Nothing in these Terms limits or excludes any rights you have as a consumer under the laws of England and Wales that cannot be limited or excluded by agreement. Those statutory rights are unaffected.

13

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSS, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

14

Suspension & Termination

Either party may terminate this agreement at any time: you by cancelling your subscription, and we by giving you reasonable notice. If you materially breach these Terms — for example, by using the Service to send unsolicited messages, by connecting accounts you have no authority over, or by attempting to circumvent limits — we may suspend your access while the breach is investigated, and terminate it if the breach is not remedied.

On termination or expiry of your subscription, your right to use the Service ends and no further charges are made.

When your subscription ends — whether you cancel, we terminate it, or you receive a refund — your Workspace Content remains for a 30-day grace period and is then permanently and irreversibly deleted. Because DijiStream keeps no separate backups, it cannot be recovered after that window by you or by us. We therefore strongly recommend that you export anything you need to keep before your subscription ends, and, where we give you notice of suspension or termination, before it takes effect. Where we end your subscription for a reason other than your breach, we will give you a reasonable opportunity to export first wherever we can.

15

Governing Law

These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. You and PITIR TECH agree to submit to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Before starting formal proceedings, we each agree to try in good faith to resolve any dispute first — you can reach us at it@dijistream.com.

16

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, give you notice by email or in the Service. Changes never apply retroactively to a billing period you have already paid for. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Free Trial

You can try DijiStream free for 14 days through self-serve signup at account.dijistream.com. No payment card is required to start a trial, and no charge is made during it — you only pay when the trial ends and you choose to continue.

The following applies to trials:

  • The free trial is limited to one per customer, business, or workspace. We may withdraw or refuse a trial where we reasonably believe it is being abused — for example, by creating multiple workspaces to obtain repeated trials.
  • Because we hold no payment card during the trial, we cannot charge you automatically. To keep your Workspace active past day 14, you subscribe to a plan through Shopify. If you do not, your Workspace is paused and then, like any subscription that ends, follows the 30-day grace period described under “Your Content and Data” before its content is permanently and irreversibly deleted — and because we keep no backups it cannot be recovered after that window, so export anything you created during the trial that you want to keep before your trial ends.
  • During the trial the Service is provided on the same “as is” and “as available” basis as a paid subscription, and all of these Terms apply.

We may change or end the free-trial offer at any time. Any change applies only to trials started after the change and never affects an existing paid subscription.

19

Data Protection and Sub-processors

This clause supplements, and should be read together with, our Privacy Policy, which governs data-protection matters in full; where this clause and the Privacy Policy differ on a data-protection point, the Privacy Policy prevails.

Roles. For your Workspace Content — the messages, leads, contacts, comments and reviews ingested from your Connected Accounts, and everything your team creates in your Workspace — you are the data controller and PITIR TECH is your data processor. We process Workspace Content only to provide the Service and only on your documented instructions, which these Terms, the Privacy Policy, and your use of the Service represent, and we will tell you if we consider an instruction to breach data-protection law. For your account and billing data, PITIR TECH is the controller. We never sell your Workspace Content, we never share it except with the sub-processors and Connected Accounts needed to run the Service, and we never use it for our own advertising or to train artificial-intelligence models.

Your responsibilities as controller. You confirm that you have a lawful basis to collect and process the personal data in your Workspace, that you have given any notices and obtained any consents the people you contact require, and that your instructions to us comply with applicable data-protection law, including the UK GDPR and the EU GDPR where they apply to you.

Security measures. The Service is hosted on Amazon Web Services in the EU (Stockholm region, eu-north-1), on ECS Fargate compute behind an application load balancer, with data held in Amazon RDS for PostgreSQL. Workspace Content is encrypted at rest with AES-256 using KMS-managed keys, and the credentials for your Connected Accounts are additionally encrypted at the application layer with AES-256-GCM. Traffic to and from the panel is encrypted in transit with TLS. The panel is accessible only to authenticated users and supports two-factor authentication (TOTP and passkeys), role-based access controls, cross-site-request-forgery protection, and rate limiting. No security measures can be guaranteed to be absolute, but we maintain measures appropriate to the risk in line with our obligations as a processor.

Sub-processors. You authorise us to engage the sub-processors needed to run the Service — currently Amazon Web Services (EU regions) for hosting and storage, Amazon SES for delivering your email replies, Twilio for SMS and WhatsApp messaging, and Shopify and Shopify Payments for checkout and subscription billing. The platforms you choose to connect (such as Meta, Google, TikTok, WhatsApp, YouTube, Shopify and WordPress) are independent controllers of their own processing; where you connect them, we exchange your data with them only as needed to run the connections you have set up. We will tell you before adding a new sub-processor that handles Workspace Content, and you may object by ending your subscription if you do not agree to it.

Transfers, assistance and breaches. Where personal data is transferred outside the UK or EEA, it is protected by appropriate safeguards such as the UK International Data Transfer Agreement (or Addendum to the EU Standard Contractual Clauses), the EU Standard Contractual Clauses, or a finding of adequacy. We will help you, so far as reasonably possible and taking into account the nature of the processing, to respond to data-subject requests and to meet your own security, breach-notification and data-protection-impact-assessment obligations, and we will notify you without undue delay after becoming aware of a personal-data breach affecting your Workspace Content.

Return and deletion — no backups. Your Workspace Content is held as a single live copy and we keep no separate backups of it. When your subscription ends — by cancellation, termination, expiry, or refund — the Workspace Content remains for a 30-day grace period during which you can export it, and is then permanently and irreversibly deleted. Disconnecting a Connected Account, or deleting your account, from the panel instead purges the affected content immediately and irreversibly. In every case deletion is permanent: because there are no backups, deleted content cannot afterwards be recovered by you or by us, so you must export anything you need to keep beforehand. We may retain limited account and billing records where the law requires us to keep them for longer, and we will hold those only for as long as required and solely for that purpose.

20

Beta and "Coming Soon" Features

Some channels and features are marked “coming soon”, “beta”, or similar. These are not part of the Service you are paying for today, and you should not subscribe in reliance on them.

  • Channels listed as coming soon — for example TikTok, Google Ads and Reddit — are not yet available. We give no guarantee that any planned channel or feature will be released, or that it will launch on any particular date, and we may change or drop it at any time.
  • Features we make available for early access or testing may be labelled “beta”. Beta features are provided “as is”, may change or be withdrawn without notice, and are excluded from any availability commitment and from the warranties in these Terms.

The channels that are live today are the ones shown as available on our website and inside your panel.

21

Your Indemnity

You agree to indemnify and hold harmless PITIR TECH, Ninu Limited, and our staff and suppliers from and against any claims, losses, damages, liabilities, and reasonable costs (including legal fees) arising out of or in connection with:

  • the content you handle, store, or send through the Service, including the replies you send through your connected accounts;
  • your connection or use of a third-party account without the necessary ownership, authority, or consents;
  • your breach of these Terms, of the Acceptable Use section, or of any law, platform terms, or third-party rights; and
  • your failure to meet your obligations as a data controller for your Workspace Content.

This does not apply to the extent a claim results from our own breach of these Terms or our negligence, and it is subject to the Limitation of Liability section above.

22

Events Outside Our Control (Force Majeure)

We are not responsible for any failure or delay in providing the Service that is caused by events outside our reasonable control. These include, but are not limited to, outages, changes, rate-limiting, or withdrawal of access by the third-party platforms you connect; failures of hosting, connectivity, or payment infrastructure we rely on; cyber-attacks; power or internet failures; strikes; acts of government; and natural events.

If such an event happens, our obligations are paused for as long as it continues, and we will take reasonable steps to restore the Service. If the disruption is substantial and prolonged, either of us may end the subscription; in that case the refund position is as set out in our Refund Policy.

23

General Provisions

Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us for the Service, and replace any earlier discussions or understandings.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to another company as part of a merger, acquisition, or reorganisation, provided your rights under these Terms are not reduced.

Severability and waiver. If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. If we do not enforce a right straight away, that is not a waiver of it.

No third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.

Notices and survival. We give notices by email to your account address or by posting them in the Service; you contact us at it@dijistream.com. Sections that by their nature should continue — including those on data, intellectual property, liability, and indemnity — survive the end of your subscription.

Questions about these terms?

We are happy to clarify anything about your subscription, billing, or data. We reply within one business day.
